The following demonstrates the terms of use and conditions, applicable to the use of BalluCabs.com. Before accepting the Ballu Cabs Terms and Conditions Agreement, we believe that one has fully read, understood, and accepted these terms of use and conditions Agreement.

Ballu Cabs is a 2016 startup firm opened by Mr. Balveer Singh Rathore and is rated as one of the most trusted one way cab firms in Jaipur city.

Upon accepting this agreement, both the parties agree to work together on the following terms of use and conditions.

Subject of Agreement –

These terms of use agreement determine the relationship between the parties, their rights, regulations, and obligations, list and scope of transactions, key commercial conditions, terms of payment, service usages, the validity of the agreement, and terms of cancellation.

Payment Procedure –

Payment Mode Offline –

• Allow all banks debit cards (Master/Visa/Rupay)
• Allow all bank Credit cards (Master/Visa/American Express)
• Net banking
• All UPI

Procedure –

After confirmation of services –

• You will get a link on your mobile for making the payment from our payment gateway company.
• Next, you will be requested to provide your credit/debit card details that including your card number, card expiry date, CVV number, and card holder’s name.
• Do not close or refresh until you are redirected to the bank verification window.
• Only after bank verification, we will confirm your booking.

Important Note –

1. We do not accept Cash Receipts or Cash Payments in Accounts. Please make Payments by Cheque / Bank Transfer / RTGS / NEFT / IMPS Only
2. From 01st July 2017 Onwards GST will be applicable & hence Package / Hotel / Travel Service Rates quoted before that will be subject to change as per change in Government Taxes.

Cancellation and Refund –

If in any case, the client cancels a tour with us then the client may be liable to pay cancellation charges. Notice of cancellation must be made in writing in the name of Ballu Cabs. Upon receipt of confirmation of booking, some percentage of the total amount paid will be refunded, but in some particular cases, the cancellation charges can depend on the timing of the cancellation.

Note: If customers don’t appear at the time and place designated as the pickup point, all paid amounts will be non-refundable.

• The Taxi Booking Cancellation policy will be applicable as per Taxi Policy + Ballu Cabs Service Charges.
• The Airline Cancellation policy will be applicable as per Airline Policy + Ballu Cabs Service Charges.
• The Hotel Cancellation policy will be applicable as per Hotel Policy + Ballu Cabs Service Charges.
• Kindly confirm the cancellation policy with us at the time of booking

Please Note – #Refund

• If you have to cancel your booking under a refundable policy of Hotel & Airline & other services then a partial refund is applicable.
• In case of Non- refundable booking then there will be no refund once confirmed the booking. please know the policy before booking.
• The refund amount will be processed only when Ballu Cabs will receive the refund amount from Airline & Hotel & other services.
• Kindly share your complete bank details like Account holder, Account no, Bank Name, IFSC Code, and Branch Area to process the refund.

Travel Insurance –

Ballu Cabs does not provide any travel insurance. We recommend our clients take a comprehensive travel insurance cover prior to the commencement of the tour. We recommend the following categories given below, which should be included in the insurance plan:

1. Tour cancellation and interruption: It should cover the payments made for non-refundable trips by air and/or land, due to interruptions during the tour or due to cancellation prior to departure of the tour, which may include events like accidents, and sickness, injury, etc.
2. Medical reasons: It should cover the cost of hospital charges including medicines, hospitalization, operation, and emergency services.
3. Baggage: It should cover the purchase of clothing and other accessories, which may be required in the event of baggage being stolen, delayed, or damaged.
4. Trip delay: It should cover lodging expenses and meals in the event that your trip is delayed.

Booking Procedure –

Any type of booking like Taxi Booking, Holiday package, Airline Booking, Hotel Booking or Travel Insurance, etc. After quotes of any new booking, Ballu Cabs will not confirm the booking until received the written confirmation from our representative. We’ll only confirm the booking once the customer or travel agent replies through the mail and fill the booking form us. The booking form is only required while making any holiday booking i.e Domestic & International tour.

Taxi Bookings –

1. Ballu Cabs is only responsible for interstate (Rajasthan) transportation in commercial cabs only.
2. Ballu Cabs will only visit tourist destinations that have been mentioned on their website BalluCabs.com
3. BalluCabs will not pay for the entrance fee of tourist attractions, parking charges, and toll charges. All these will be paid for by the guest.
4. Ballu Cabs acknowledge that all their vehicles are from the state of Rajasthan with correct insurance papers, and commercial license and all drivers are from the state and carry commercial license provided by the state of Rajasthan.
5. Ballu Cabs do not suggest any hotel (accommodation place), shopping showrooms, or food joints to any guests. All these are up to the guest to choose and Ballu Cabs will just drop them at these destinations. Hence any miscommunication or fraud done by these 2nd party establishments is between them and the guest. We (Ballu Cabs) are not responsible for this.
6. Ballu Cabs have mentioned the prices of their services on their website BalluCabs.com and for discounts we encourage guests to call us. Any 2nd party price will not be acceptable to Ballu Cabs.
7. Ballu Cabs confirms that any communication details of the guests like phone no, email and id proof will not be shared with any private enterprise. It can only be given to the government if they are asked for the reason of public safety only.
8. A message from Ballu Cabs to all – Jaipur is famous for its shopping sites and has many shopping showrooms too. But in recent years, many tourists have been cheated by tour guides, shopkeepers & even cab drivers. Thus it is our responsibility to tell you to not believe in any person in Jaipur that he or can offer great artifacts at a lower price, not even our drivers.

Hotels –

There may be certain surcharges applicable at the time of booking the hotel. The above prices are on Per person basis on Double Occupancy. Hotels suggested in the itinerary can be changed and will be equivalent or more to the one given to you in terms of price as per the official rate sheet of the hotel. We book the room in a certain room type. Any kind of upgrade or downgrade given to the client by the hotel is as a dispute between the hotel and the client for which we have no control. Also, any kind of amenities or services not provided by the hotel will be a dispute between the hotel or airline and the client. The hotel will give the room double or twin as per the availability for which we have no control, the said is between the client and the hotel (bedding type availability). Any damage caused to the hotel rooms/coach/place of visit etc. during your stay/tour/visit. Shall be borne and payable to you, and the company will not be liable for the same.

Tour itinerary Transfer & Sightseeings –

This is a tentative itinerary. All transfers and sightseeing are on Seat in coach basis. The services are subject to availability. The above itinerary is for reference purposes only. The inclusions mentioned in the itinerary are for reference purposes and all the inclusions to subject to your package type based on the below pricing and acceptance. The above-suggested itinerary is only for indication and can be changed. Please make sure you follow the timings given by the driver and guide for all the services and transfers. In case you fail to follow the timings, the Driver will leave for which no refund will be given. Please note that the above holiday is a fixed holiday for which any alteration or changes are not possible and any request for changes is subject to approval and availability.

Health –

Please note that the above tour might require physical activity whereby a lot of walking is needed at theme parks and other tours. The tour might also require long hours of tours and arrivals which can be very late or early in the morning. All clients are expected to take a full medical check-up with a doctor’s approval before taking the above holiday package. In case any client is facing any medical problem, it is highly advisable to consult the doctor before undertaking the above holiday. Also, Ballu Cabs takes no responsibility in case there is a medical illness during or after the tour because of any reason.

Baggage –

All baggage and personal effects are at all times and under all circumstances your responsibility. We will not be responsible or liable in case of loss of such items from hotel premises/coach/Airport / during travel or place of visit etc. Some hotels offer the facility of safe deposit lockers, which can be availed of by you at your own cost and risk. The Company will not be liable for any loss/theft from the same

Tour Cost –

All above rates are subject to availability and can be changed without prior notice. We have quoted above the best available rates as of now. Actual ROE is charged at the time of confirmation. The above has been calculated as per today’s exchange rate. Any change in the exchange rate will change the above pricing. The above tour cost is calculated as per the current taxes, visa charges, and other charges as per the current date. Any change till the time of departure. Any additional cost of such nature will have to be taken care of by the client. Tour cost will be remaining the same once confirmed between customer and Company. The company will not pay if, other companies offer such other services or different tour costs.

Airline –

The flight details are mostly fixed but can change as well with an alternate flight (mostly in the case of date change) Any kind of delays in flight such as fog or technical problem Is not the responsibility of Ballu Cabs and any kind of hotel cancellations and no shows will be the responsibility of the client. If in the event that the client is booked on a particular airline on a particular date or due to certain reasons beyond the control of the company, the client is not allowed to board the flight, the client shall not hold the company responsible for the same and no claim whatsoever can be made by the client against the company.

Accommodation for children below 12 Years of Age –

It is expressed and given to understand that a child below 12 years of age who is booked on the tour paying the special rate without a bed will not be provided with a bed in the hotel while on the tour under any circumstances, In case the client makes any changes in their rooming while on the tour, the company shall not make any refunds or pay any compensation to them. In case the clients decide to make any changes while on the tour subject to availability, then they shall be bound to pay additional charges.

Visas –

Please note to take care of the visa processing and its time as we will not be responsible for any kind of delays or refusal of visa from the concerned consulate and the cancellation policy of the holiday will be applied.

Site And Its Contents –

You are not allowed to sell, modify, distribute or do any such activity from the site which include but are not limited to video, text, audio, and images for business purpose. It can be only used for personal purposes. As long as you comply with the Terms and Conditions of Use, Ballu Cabs grants you a non-exclusive, non-transferable, limited right to enter, view, and use this Site. You agree not to interrupt or attempt to interrupt the operation of this Site in any way.

To become a registered user on the site you are required to answer some questions which are both mandatory and optional. You represent and warrant that all information you supply to us, about yourself, and others, is true and accurate.

Ownership –

All materials on this Site, including but not limited to audio, images, software, text, icons, and such like (the “Content”), are protected by copyright under international conventions and copyright laws. You cannot use the Content, except as specified herein. You agree to follow all instructions on this Site limiting the way you may use the Content.

There are a number of proprietary logos, service marks, and trademarks found on this Site whether owned/used by  Ballu Cabs or otherwise. By displaying them on this Site, Ballu Cabs is not granting you any license to utilize those proprietary logos, service marks, or trademarks. Any unauthorized use of the Content may violate copyright laws, trademark laws, the laws of privacy and publicity, and civil and criminal statutes.

You may download such copy/copies of the Content to be used only by you for your personal use at home unless the sub-site you are accessing states that you may not. You are not allowed to remove trademark or copyright notices if you copy any content from the website.

Ballu Cabs Rights –

In case you send any communications or materials to the Site by electronic mail or otherwise, such communications are, and will be treated by Ballu Cabs, as non-confidential. You hereby give up any and all claim that any use of such material violates any of your rights including moral rights, privacy rights, proprietary or other property rights, publicity rights, rights to credit for material or ideas, or any other right, including the right to approve the way Ballu Cabs uses such material.

Other’s Rights –

You are agreed to use the same facilities such as bulletin boards, chat rooms, access to a mailing list,s or other messages from the website to send and receive messages and materials that are accurate and related thereto. By way of example and not as a limitation, you agree that when using the Site or any facility available here, you shall not do any of the following:

• Defame, abuse, harass, stalk, threaten, or otherwise violate the legal rights (such as rights of privacy and publicity) of others;
• Publish, post, distribute or disseminate any defamatory, infringing, obscene, indecent, or unlawful material or information;
• Upload or attach files that contain software or other material protected by intellectual property laws (or by rights of privacy and publicity) unless the User owns or controls the rights thereto or has received all consents therefore as may be required by law;
• Upload or attach files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another’s computer;
• Delete any author attributions, legal notices or proprietary designations, or labels in any file that is uploaded;
• Falsify the origin or source of software or other material contained in a file that is uploaded;
• Advertise or offer to sell any goods or services, conduct or forward surveys, contests, or chain letters, or download any file posted by another user of a Forum that the User knows, or reasonably should know, cannot be legally distributed in such manner.

User’s Material –

You are prohibited from posting or transmitting any defamatory, libelous, obscene, pornographic, profane, threatening, or unlawful material or any material that could constitute or encourage conduct that would be considered a criminal offense or give rise to civil liability, or otherwise violate any law.

Ballu Cabs assumes no liability or responsibility arising from the contents of any communications containing any defamatory, erroneous, inaccurate, libelous, obscene, or profane material. Ballu Cabs may change, edit, or remove any user material or Ballu Cabs conversations that are illegal, indecent, obscene, or offensive, or that violate policies in any way. Ballu Cabs will fully cooperate with any law enforcement authorities or court order requesting or directing Ballu Cabs to disclose the identity of anyone posting such materials.

Terms And Conditions For Cab Usage –

• The client is required to pay the taxi fares, parking charges, and night charges additionally which are imposed by the law to pay for taking taxi services.
• The customer agrees and accepts that the use of the Services provided by the Company is at the sole risk of the Customer, and further acknowledges that Ballu Cabs disclaims all representations and warranties of any kind, whether express or implied.
•  The customer shall ensure that he/she will not indulge in any of the following activities while in a taxi:
  • Smoking or consuming any kind of intoxicants inside the Taxi. The driver has the right to refuse the pick-up or ask the customer to alight the cab if the customer is found to be in an intoxicated state or is found misbehaving with other passengers or the driver, or is causing a nuisance;
  • Littering the Taxi;
  • Soiling or damaging the seats and/or any other interiors of the Taxi;
  • Misusing, soiling, or damaging any of the devices (technical/non-technical) in the taxi;
  • Asking the driver to break any Traffic/RTO/City Police and/or government rules for any purpose (especially reaching the destination earlier). The driver has the right to refuse such a request by the customer. The driver also has the right to refuse such a pick-up or ask such customer(s) to alight from the cab;
  • Asking the driver to board more passengers than the seating capacity in the taxi. The driver has the right to refuse such a pick-up or ask such customer(s) to alight from the cab.
•  The customer agrees and acknowledges that the use of the Services offered by the Company is at the sole risk of the customer and that Company disclaims all representations and warranties of any kind, whether express or implied as to condition, suitability, quality, merchantability, and fitness for any purposes are excluded to the fullest extent permitted by law. Without prejudice to the above, the Company makes no representation or warranty that:
  • The Services will meet the customer’s requirements;
  • The Services will be uninterrupted, timely, secure, or error-free.
  • The Company is not responsible for any damage or loss which is caused by the customer while taking taxi services offered by the company. Also, due to the failure of the Company to provide Services to the Customer for any reason whatsoever including but not limited to the Customer’s non-compliance with the Services’ recorded voice instructions, malfunction, partial or total failure of any network terminal, data processing system, computer tele-transmission or telecommunications system or other circumstances whether or not beyond the control of Company or any person or any organization involved in the above-mentioned systems.
  • The Company will not be liable for any damages of any kind arising from the use of the Service offered by the Company, including, but not limited to direct, indirect, incidental, punitive, and consequential damages.
  • The Company is not responsible for any compensation if the passenger misses the train or flight. The customer is responsible for managing his trip/travel timely. The customer shall make an alternate arrangement if the cab has not reached due for any reason.
• The Customer shall indemnify Company from and against and in respect of any or all liabilities, losses, charges, and expenses (including legal fees and costs on a full indemnity basis) claims, demands, actions, and proceedings which Company may incur or sustain directly or indirectly from or by any reason of or in relation to the use or proposed use of the Services by the Customer and shall pay such sums on demand on the Company.
• The Company shall be entitled at any time without giving any reason to terminate the booking of taxis booked by the Customer.
• The company says all its customers to be responsible for their items. The company will not be liable for loss or damage of the same but will strive best to locate the items that were lost during the journey.
• If the Customer leaves any goods in the taxi or has any complaint in respect of the Services or the use of the taxi, the Customer has to inform Company of the same in writing within 12 hours of using the taxi or the Services of Company.
• The Company is not responsible for any conduct of the drivers of the taxis. However, the company supports you to notify if they have any complaints against the driver of any taxi that you have booked using the Company’s services.
• The Company shall be entitled to add to, vary, or amend any or all these terms and conditions at any time and the Customer shall be bound by such addition, variation, or amendment once such addition, variation, or amendment is incorporated into these terms and conditions at Company’s website at www.BalluCabs.com on the date that Company may indicate that such addition, variation or amendment is to come into effect.
• It is expressly made clear to you hereby that the Company does not own any taxis nor does it directly or indirectly employ any drivers for the taxis. Taxis and drivers are all supplied by third parties and the Company disclaims any and all liability in respect of the drivers and the taxis alike.
• The company has the right to use the customer details such as contact information for its marketing purposes. The company can send regular emails or SMS to the registered mobile number to update customers about their services.

The above-mentioned terms and conditions of use and/or Agreement and the Privacy Policy constitute the entire agreement between the User(s) and Ballu Cabs with respect to access to and use of the website and the Services offered by Ballu Cabs, superseding any prior written or oral agreements in relation to the same subject matter herein.

Conditions of Travel –

The Client will have to strictly follow the Tour Program and return to India as per the tour Itinerary. There shall be no refund if the client fails to join the group at the commencement of the tour, joins the group later, or leaves the group before the culmination of the tour. It shall be noted that for all purposes. It shall be the representative of the company at the appointed place, date, and time.

Others Provisions –

You may travel to certain destinations through certain routes which involve greater risks, entirely at your risk as to the cost and consequences. Ballu Cabs requests you to consult your local authorities and evaluate travel prohibitions, warnings, announcements, and advisories issued by them before booking travel to certain destinations through certain routes. By promoting (through discounts and deals) any travel to particular destinations through particular routes, Ballu Cabs does not represent or warrant that travel to such point is advisable or without risk. Ballu Cabs is not liable or responsible for any damages, delays, or damages that may occur from travel to any destinations. Ballu Cabs, its Affiliates, and their respective suppliers are not liable for the acts, errors, omissions, representations, warranties, breaches, or negligence of any taxi/car rental operators or other suppliers for any personal injuries, death, property damage, or other damages or expenses resulting therefrom. Ballu Cabs, its Affiliates, and their respective suppliers have no liability and will make no refund in the event of any delay, strike, force majeure, or other causes beyond their direct control, and they have no responsibility for any additional expense, omissions, delays, re-routing or acts of any government or authority.

Validity –

The above-stated terms of use agreement come into force from the date of acceptance by the client. These terms of use agreement shall remain valid until further amendments or notices are issued by Ballu Cabs Terms and conditions of use may change from time to time so please check the website periodically.

Agreement Termination –

Without prejudice Ballu Cabs reserves all the right, at its sole discretion, to terminate the client’s access to the materials or to all or part of this website, with or without notice.

Governing Rule –

These terms of use and conditions shall be governed by and constructed in accordance with the laws of India without reference to conflict of the laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the court of Moga.
